MA BICHE KEMER BY WERDE HOTELS PRIVACY NOTICE
SEKİ İNŞAAT VE TİCARET A.Ş, as “MA BICHE KEMER by WERDE HOTELS”, hereby informs you that we act in accordance with the Law on the Protection of Personal Data No. 6698 (“PDPL”) and that we show the necessary sensitivity regarding the processing, recording, transfer, sharing and storage of all kinds of personal data and special categories of personal data belonging to our valued customers. Due to this sensitivity and our Company Policy, we would like to state that the data reaching our company is processed into the system only to the extent necessary because “which data will be collected is determined according to the purpose of collection”. The data declared by our valued customers and/or collected by automated or non-automated means are carefully processed, shared, transferred and stored, with administrative and technical measures taken to improve the quality of the services we provide; data that are not necessary are deleted. Within the scope of Article 10 titled “Information Obligation of the Data Controller” and Article 11 titled “Rights of the Data Subject” of the Law No. 6698 on the Protection of Personal Data (PDPL); in order to inform you, as the data controller SEKİ İNŞAAT VE TİCARET A.Ş “MA BICHE KEMER by WERDE HOTELS” (“Company”), about the purposes for which your personal data will be processed, to whom and for what purposes your processed personal data may be transferred, the method and legal basis of the collection of your personal data and the rights you possess, we prepared this “Privacy Notice” to fulfill our disclosure obligation to our customers, business partners and natural or legal persons with whom we communicate.
1 - Purposes of Processing Your Personal Data, and To Whom and For What Purposes They May Be Transferred
• Processing of data
In order for you, our valued guests, to benefit from the products and services we offer, customized according to your preferences and habits, at the highest level of service quality and within the limits determined by the applicable legislation, we collect your personal data and process them within the conditions and purposes specified in Articles 5 and 6 of Law No. 6698. MA BICHE KEMER by WERDE HOTELS may process the personal data it has obtained by any of the collection methods stated in subsection 3 of this text within the scope of your explicit consent for the purposes of conducting the company’s core activities and legitimate interests; planning and implementation of marketing processes of products and services; conducting reporting and analysis activities; personalizing, announcing and advertising products and services to customers; and sharing with third parties with whom transfer is mandatory due to the company’s activities. In addition, when you use our call center or websites intending to use MA BICHE KEMER by WERDE HOTELS services, when you visit our companies and hotels, or when you participate in any training, seminar or event organized by MA BICHE KEMER by WERDE HOTELS for any purpose, your personal data may be processed.
• Transfer of data
In order to offer you value-added services, opportunities and benefits and to improve service quality, we share these data with our domestic or foreign affiliates, our directly or indirectly affiliated companies, our joint ventures, or with public institutions and organizations authorized to request such data due to a legal obligation, as well as with other institutions, suppliers, authorized sellers, authorized dealers and business partners with whom we have contractual relationships in the course of our activities. Personal data may be transferred to our business partners, suppliers, companies that are or will be part of MA BICHE KEMER by WERDE HOTELS, our shareholders, legally authorized public institutions and private persons for the purposes of carrying out the necessary work by our business units to make you benefit from the products and services provided by MA BICHE KEMER by WERDE HOTELS, proposing the products and services offered by our Company to you by personalizing them according to your preferences, usage habits and needs, ensuring the legal and commercial security of persons in business relations with MA BICHE KEMER by WERDE HOTELS, determining and implementing MA BICHE KEMER by WERDE HOTELS commercial and business strategies and carrying out MA BICHE KEMER by WERDE HOTELS human resources policies, within the conditions and purposes of personal data processing set forth in Articles 8 and 9 of the PDPL.
2 - Circumstances in Which Personal Data May Be Processed Without Explicit Consent as Required by Law
Pursuant to Article 5 of the PDPL, in the following cases MA BICHE KEMER by WERDE HOTELS may process your personal data, which it has obtained lawfully as described above, without seeking your explicit consent.
1. When explicitly provided for by laws.
2. When it is mandatory for the protection of the life or bodily integrity of the person whose consent cannot be given due to actual impossibility or whose consent is not legally valid, or of another person.
3. If it is necessary for the establishment or performance of a contract and is directly related to the contract, for the processing of the personal data of the parties to that contract.
4. When it is mandatory for the data controller to fulfill its legal obligation.
5. If the personal data have been made public by the data subject.
6. When it is mandatory for the establishment, exercise or protection of a right.
7. When it is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.
3 - Collection of Personal Data, Methods and Legal Basis
In order for the products and services we offer as MA BICHE KEMER by WERDE HOTELS to be provided at the highest determined service quality and within the legal framework, to be performed and, in this context, for our Company to fully and accurately fulfill the contracts and legal responsibilities arising from agreements with our business partners, your personal data, which vary depending on the service, product or commercial activity provided, are collected by automated or non-automated methods and by all kinds of verbal, written or electronic means through offices, branches, dealers, call center, website, social media channels, mobile applications and similar methods for the purposes stated above.
4 - Retention Period of Personal Data
In accordance with the PDPL, personal data processed for the purposes stated in this “Privacy Notice” shall be deleted, destroyed or anonymized by MA BICHE KEMER by WERDE HOTELS in accordance with the Policy on Deletion, Destruction and Anonymization of Personal Data published by the Company, when the purpose requiring their processing under Article 7/f.1 of the PDPL ceases to exist and/or when the statute of limitations periods that legally require us to process your data expire.
5 - Rights of the Personal Data Owner,
Within the scope of Article 11 of the PDPL and in general, we inform you that you have the following rights regarding your personal data;
1. To learn whether personal data are being processed,
2. To request information if personal data have been processed,
3. To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
4. To know the third parties at home or abroad to whom personal data are transferred,
5. To request correction of personal data if they have been processed incompletely or inaccurately,
6. To request deletion or destruction of personal data within the scope of the conditions set out in Article 6,
7. To request that the transactions made pursuant to paragraphs (e) and (f) be notified to the third parties to whom the personal data have been transferred,
8. To object to the emergence of a result against the person by analyzing the processed data exclusively through automated systems,
9. To demand compensation for the damage in case of loss due to unlawful processing of personal data,
In the processing of personal data belonging to children within the scope of the services we provide and the activities we carry out and for the purposes mentioned above, where necessary, we obtain the explicit consent of the child’s parent or legal guardian electronically or by physical forms, depending on the nature of the service provided.
When you want to exercise your rights specified in Article 11 of the Law on the Protection of Personal Data, you must fill out the PDPL Information Request Form available on our website and submit it in person to “MA BICHE KEMER by WERDE HOTELS Göynük Mah. Ahu Ünal Aysal Cad.. No : 43 Kemer / Antalya” or send it to our registered electronic mail (KEP) address [email protected]. Your requests will be concluded free of charge within thirty days at the latest, depending on the nature of the request. However, if the process requires an additional cost for the Company, a fee determined in the tariff set out in the Communiqué on Application Procedures and Principles to the Data Controller by the Personal Data Protection Board may be charged.
